Occupational Injury & Disease
Occupational Injury claims refer to injuries and diseases not caused by a specific event but are due to the performance of work duties or exposures which occur on the job over time. Many Occupational Workers’ Compensation claims commonly involve so-called “wear and tear” injuries but they also include exposures over time to harmful substances which eventually develop into a variety of diseases. A few examples of Occupational claims include:
- Chronic spinal and joint injuries from repetitive lifting, bending, climbing at work,
- Neurologic injuries such as carpal tunnel syndrome and cubital tunnel syndrome from repetitive hand and arm motion at work, and
- The development of diseases such as asbestosis and cancer from work place exposure to asbestos.
As with specific accident claims, fault is irrelevant and the work activity or exposure need not be the sole cause of the injury or disease for compensability purposes so long as they were a material contributing factor. Our Workers’ Compensation Attorneys can help you understand your case, and how and when it should be filed.
WHEN MUST AN OCCUPATIONAL CLAIM BE FILED?
Generally speaking, the Statute of Limitations deadline for filing an Occupational injury or disease claim with the State of New Jersey is the two year anniversary of the date the injured worker knew or should have known of the injury or disease and its causal connection to the employment. However, if an Occupational claim is accepted as compensable and Workers’ Comp benefits are provided for the claim involved, the Statute of Limitation filing deadline is extended to the two year anniversary of the last benefit received.
