Have you or a loved one suffered an occupational injury or disease? If so, the injured person may be entitled to some form of disability. Read on to learn which form of disability you may quality for.
Permanent Total Disability
Unfortunately, some workplace injuries result in permanent disability in NJ, meaning the injured person is unable to resume employment of any kind. If you are unable to work due to an occupational injury or an injury that impacts a pre-existing disability, you are entitled to Permanent Total Disability Compensation (PTD) and free future medical treatment as necessitated by your work injuries. Unless you later recover from the injury and are able to resume employment, a disabled person under this category will be awarded permanent total disability for life.
Permanent Partial Disability
Permanent Partial Disability (PPD) is the most common worker’s compensation claim, accounting for more than 50% of claims nationwide. A permanent partial disability in NJ can be caused by an occupational injury or disease. Those who qualify for this form of disability suffer from a permanent impairment that makes them unable to perform their duties to their full capacity. A person with permanent partial disability is not totally disabled and is able to resume some form of employment. Common injuries under this category include hearing or vision loss, nerve damage, amputation of a finger or hand, or knee injury.
Temporary Disability
Temporary disability is awarded to individuals who are receiving active medical treatment – and therefore temporarily disabled – due to an occupational injury or disease. A person who is temporarily disabled is entitled to social security disability benefits as long as there is a provable loss of income. A temporarily disabled person can collect temporarily disability for up to 400 weeks, so long as there is medical proof and with the help of a qualified disability attorney.
