Specific Accident Claims In South Jersey

The majority of Workers’ Compensation claims are based upon injuries caused by a specific event happening in the course of employment. They encompass all activities performed by an employee and things which occur to an employee while working. Some common examples include injuries resulting from:

• Lifting or being struck by an object
• Motor vehicle accidents
• Slip, trip and fall downs
• Twisting, turning and bending trauma
• A single exposure to a harmful substance or excessive noise
• Assaults

The cause of and fault for the accidental injury is normally irrelevant so long as it arose out of and in the course of employment and was not due to intentional self-infliction of harm. To be compensable, the specific event need not be the sole cause of the injury. Accidents which aggravate, accelerate and/or exacerbate a preexisting medical condition also entitle New Jersey workers to workers’ compensation benefits.

WHEN MUST A SPECIFIC ACCIDENT CLAIM BE FILED?

The Statute of Limitations refers to the deadline within which a workers’ compensation claim must be filed with the State in order to receive Court ordered benefits.

For specific accident claims, the Statute of Limitations filing deadline is the later of:

1. The two year anniversary of the date of accident; or
2. Two years from the last workers’ compensation benefit provided by the employer or its WC insurance fund under the specific claim involved.
