Workers’ COMP MEDICAL TREATMENT BENEFITS
IN South Jersey
Medical Benefits in Workers’ Compensation Cases in Atlantic City & Southern New Jersey
The workers’ compensation insurance carrier or self-insured employer is obligated to cover 100% of the reasonable and related charges for medical treatment necessary to cure the work injury or occupational disease. There are no co-pays, deductibles, limits and no balance bills to be satisfied by the injured worker. However, NJ law gives the insurance carrier or self-insured employer the near absolute right to select the treating physician(s) and medical provider(s) they will be responsible to pay. Except in emergency circumstances, prior approval or authorization for treatment must be obtained from the employer or WC insurance company. If a physician has been authorized to render treatment, the insurance company or employer is legally responsible to pay for such treatment and diagnostic testing ordered or prescribed by the authorized physician(s). However, in denied claims, where no medical attention is authorized, the Workers’ Compensation Court has the power to order coverage for unauthorized care if it is determined that the claim should not have been denied and the unauthorized treatment charges are reasonable, necessary and related to the work injury or disease.
