WHEN MUST AN OCCUPATIONAL CLAIM BE FILED?

Generally speaking, the Statute of Limitations deadline for filing an Occupational injury or disease claim with the State of New Jersey is the two year anniversary of the date the injured worker knew or should have known of the injury or disease and its causal connection to the employment. However, if an Occupational claim is accepted as compensable and Workers’ Comp benefits are provided for the claim involved, the Statute of Limitation filing deadline is extended to the two year anniversary of the last benefit received.
